1. Agreement to Terms

By accessing or using EventWall ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

EventWall is an interactive photo wall service that allows event organizers to create digital photo walls where guests can share photos and messages in real-time during events.

The Service includes both free and premium subscription tiers with different features and limitations as described on our website.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You must provide accurate and complete information and keep your account information updated.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Subscription and Payments

4.1 Free Tier

  • Maximum 50 posts (photos and messages combined) per event
  • Events expire after 3 days
  • 1 theme available

4.2 Plus Tier (€29 incl. VAT)

  • Maximum 500 posts (photos and messages combined) per event
  • Events expire after 30 days
  • 4 themes available
  • ZIP download of all photos

4.3 Pro Tier (€59 incl. VAT)

  • Maximum 1,000 posts (photos and messages combined) per event
  • Events expire after 60 days
  • 4 themes available
  • ZIP download of all photos

4.4 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees. All prices include VAT.

4.5 Refund Policy

Paid upgrades are non-refundable once the payment is processed and the upgrade is applied to your event. If you experience technical issues, please contact us for assistance.

5. User Content

5.1 Content Ownership

You retain ownership of all content you upload to the Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and providing the Service.

5.2 Content Responsibility

You are solely responsible for all content you upload or share through the Service. You represent that you have all necessary rights to share such content.

5.3 Prohibited Content

You agree not to upload content that:

  • Is illegal, harmful, threatening, abusive, or defamatory
  • Infringes on intellectual property rights of others
  • Contains sexually explicit or pornographic material
  • Contains viruses or malicious code
  • Violates the privacy of others
  • Is spam or commercial solicitation

6. Content Moderation

Event organizers may enable content moderation to review submissions before they appear on the photo wall. We also reserve the right to remove any content that violates these Terms without prior notice.

We use automated filters to detect inappropriate content, but we do not guarantee that all prohibited content will be caught.

7. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are owned by EventWall and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVENTWALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify and hold harmless EventWall and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Finland.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
